Foreign ownership quota for condominiums
Where a foreign buyer plans to register freehold ownership of a condominium unit, confirm the building's status and whether the permissible foreign-ownership quota is available. Request the relevant confirmation from the condominium juristic person and understand the land-office documentation needed for transfer. Broad advertising claims such as 'freehold for all buyers' are not a substitute for project-specific evidence.
Ownership versus leasehold structures
Villas and land are frequently presented through different legal arrangements, including leases and other contractual rights. Review their term, registration, renewal, transferability, inheritance and consequences on resale with independent Thai counsel. A marketing phrase such as 'ownership' does not tell you exactly which right you will receive.
Funds, condominium management and rentals
Ask your bank and advisers which evidence of remittance and source of funds will be needed at transfer. Compare common-area fees, maintenance reserves, insurance and any restrictions on short-term letting. Annual rental returns should not be extrapolated from a peak-season nightly rate without allowing for vacancy and expenses.
